Sports 1 Marketing Corp., a Delaware corporation (hereafter "S1M," "we," "our," or "us"), has developed this Data Privacy Policy (“Privacy Policy”) to inform users (each hereafter “user,” “you,” or “your”) as to how information about you is collected, used, disclosed, and protected by S1M when using S1M’s websites, mobile applications, and our other online or digital services (collectively hereafter our “Service” or "Services").

You are accepting and agreeing to abide by this Privacy Policy when you check the Services homepage box that reads, “I agree to the Terms and Conditions, and I have reviewed the Privacy Policy,” or where you otherwise use our Services (collectively herein referred to as “Opting In”). The Privacy Policy may be changed from time to time. If we make changes, we will notify you by revising the date that follows the colon behind the “Last Updated” language found above—located under the Data Privacy Policy title of this document. We encourage you to review the Privacy Policy whenever you access our Service. Continued use of our Service after changes have been made and notice has been given via an updated “Last Updated” date shall constitute an acceptance of the Privacy Policy as changed. Our Service

S1M afford users access to our websites, mobile applications, and other online and digital services. As a user of our Services you are also afforded access to participate in our Aggregated Marketing Platform. A component of our Aggregated Marketing Platform is a Virtual Gift Bag Application (“VGB”), which includes the ability to build “Swag Bags” made up of your choice of gifts from S1M and/or third-party AMP Sponsors (“Sponsors”). Additionally, where such is provided for in a VGB, you may have access to enter into any number of included, random sweepstakes drawings. In every VGB you are also afforded an opportunity to donate to charitable causes.

By using any of our Services, you provide consent for us to collect personal and non-personal information about you. You share some of this information with us when you input it into our Service, while other information is collected automatically. As a user of our Service you consent to our sharing of your personal, non-personal, user-input, and automatically shared information with Sponsors. For example, when claiming a gift in the VGB, you authorize us to share data about you with the Sponsor who is the provider of the gift.

You hereby acknowledge and agree that we do not control the use, processing, storage, transmission, or any other dissemination of your information by Sponsors. You further acknowledge and agree that a Sponsor and their third-party service providers may be located anywhere in the world, including, without limitation, the United States of America, South America, Asia, Africa, Australia, and/or the European Economic Area. You also acknowledge and agree that any information may be received, processed, managed, and/or stored by us or Sponsors located anywhere in the world, including, without limitation, in the United States of America, South America, Asia, Africa, Australia, and/or the European Economic Area. S1M is based in the United States and U.S. law governs the information we collect.

Monetary Transactions

S1M may advertise its own purchasable products within our Services. Even where such occurs, transactions for those products will take place outside of our Services and be subject to, if at all, the privacy policies of the processing agent or as provided on the landing/re-route page, but not by S1M through its VGB. A purchase of a product from an advertising partner or Sponsor found in our Gift Bag (“Outside Purchase”) will never be processed within our Services, and as such, the data collection and privacy protections of a purchase placed in this context will be governed, if at all, as prescribed by the seller, Sponsor, third-party, or seller-prescribed entity, not be it us. Please refer to an appropriate privacy policy for your purchase in order to acquire further information as to Outside Purchases.

Donations

We appreciate all users who decide to pay it forward and donate to parties contained in our VGB. Donations made to parties accessed through our VGB shall be subject to the privacy policies and data collection practices, if at all, as prescribed on the landing page to donate, or as provided by the actual receiver of the donation.

Sweepstakes

Sweepstakes may be a component of any VGB. Sweepstakes entrants are subject to this Privacy Policy. Please view the Official Rules that accompany any VGB Sweepstakes to answer any further questions specific to such Sweepstakes.

Purpose of Collecting Your Information

When you use S1M’s Services, you trust us with your information. Our Privacy Policy is meant to help you understand what data we collect, why we collect it, and what we do with it. Our primary objective in collecting user information is to provide and enhance the Service and to enable users to enjoy the Services in a unique manner. Additionally, and more specifically, your data is collected with the intention to process it for the following purposes, including but not limited to:

maintaining the commercial relationship between involved parties; statistical analysis; management of the additions and deletions of user records; organization of services and events; the management of requests and applications; the development of customer satisfaction surveys; issuance of newsletters or magazines; marketing of products or services; personalized future navigation, communications, offers, and shopping experiences; the sharing of commercial communications meant to adapt to your buying habits— including S1M-related electronics, supplies, and services; products linked directly to an entity marketing a product within our Services; or those marketed by third-parties with which entities marketing within our Services collaborate.

How Your Information is Collected

Users of our Service provide us with information they input into our Services and other information is automatically collected when users access our Service. In order to register for our Services, you may be asked to sign-in using information relevant to and meant to identify you. You may also be asked to sign-in and/or attach accounts with any of your social networks (such as your Facebook or LinkedIn) and their accompanying log-in credentials. By signing in via a social network log-in, you authorize us to access certain social network account information from the social network site you use to log in. This account information is made accessible for our collection and includes information about your social network contacts (such as your Facebook or LinkedIn friends). By allowing us to access your social network account, you understand that we will obtain and may share, without limitation, your name and profile picture, as well as the name and profile picture of any of your contacts. When you register to, or use the Services, or any portion thereof, we may collect and record the information you provide to us, whether this information is provided through the Service, through social networks, or via other third-party services.

1. Information You Provide to Us

S1M, through our Services, collects information that you provide directly to us. For example, we collect contact information when you register or update the details of the account you connect to any of our Services. As part of accessing our Service, you directly and generally provide us, and we subsequently collect, information that is not limited to, but may include your:

full name; postal address—including city, state, and zip code; email address, account password; date of birth; gender; telephone number; Facebook login information, pictures, and profile identifier; credit or debit card information; as well as any further information you voluntarily provide in any correspondence with us or when using our Services.

Note: If you provide us with personal information of other persons, we warn you that you must do so with their consent, where necessary; and if indeed necessary, you are obliged to inform them of our Privacy Policy before providing us with their information (such as if you were to win a sweepstakes that required you to input another party’s information as your accompanying guest).

2. Information Collected Automatically

When you use any of our Services, there is information that is shared with us and collected automatically. For example, when you use our website we collect your IP address and standard web log information (such as your browser type and the pages you access on our website). We may also collect certain geo-location information. If you do not agree to allow us to collect this information, there exists a risk that you may not be able to use our Services. We use various technologies to collect information, and this may include sending cookies to your computer, mobile device, and/or online accessing machine. Cookies are small data files stored on your hard drive or in your device’s memory. Thanks to cookies, it is possible for S1M to recognize the browser of the computer used by the user, which in turn allows us to facilitate content and offer navigation preferences or advertising to the user. Further, the data provided by cookies, such as the pre-selection of your language or any other more specific or desired content, aids us to customize your use of our Service. The demographic profiles of users, measure of visits and traffic parameters, and monitored progress and number of entries by users are non-exhaustive examples of the specific data that we collect. Please see your browser, mobile device, or online capable machine for any options and instructions to disable or delete cookies.

We may also embed pixel tags (also called tracking pixels, web beacons, or clear GIFs) in web pages, ads, and emails. These tiny, invisible graphics are used to access cookies and track user activities (such as how many times a page is viewed). Pixel tags help us to understand usage, campaign effectiveness, popularity of our features and Services, and they inform us as to whether an email has been opened and acted upon. Ad companies also use pixel tags to measure the number of ads displayed and their performance (such as how many people clicked on an ad).

If you're using our Service, we may use mobile device IDs (the unique identifier assigned to a device by the manufacturer), or Advertising IDs (for iOS 6 and later), instead of cookies, to recognize you. We do this to store your preferences and track your use of our Service. Unlike cookies, device IDs cannot be deleted, but Advertising IDs can be reset in “Settings” on your iPhone. Ad companies also use device IDs or Advertising IDs to track your use of the Service, track the number of ads displayed, measure ad performance, and display ads that are more relevant to you. Analytics companies use device IDs to track information about application usage.

We may allow service providers, advertising companies and ad networks, and other third-parties to display advertisements on our Service. These companies may use tracking technologies, such as cookies or pixel tags, to collect information about users who view or interact with their advertisements. Some of these third-party advertising companies may be advertising networks that are members of the Network Advertising Initiative, which offers a single location to opt out of ad targeting from member companies ( www.networkadvertising.org). opting out, via the link immediately provided before, will not decrease the number of advertisements you see.

Types of Information We Collect about You

Users of our Service provide us with both personal and non-personal information.

1. Personal Information

"Personal Information" is information about you that can be used to contact or identify you. The Personal Information types collected from you may vary depending on your Service activity. The types of Personal Information collected may, without limitation, include your:

full name; location; addresses—including city, state, and zip code; email address; country code; biography; personal site; avatar; Facebook, LinkedIn, Twitter, and/or any other social network profile link; profile pictures; employer’s name; employment title; employment role; languages communicated in; education details; list of connections on social networking sites (such as your friends list on Facebook); as well as any other relevant information included in communication with us, our Service, social networks, or other online profiles.

2. Non-Personal Information

"Non-Personal Information" is information that, when taken alone, cannot be used to identify or contact you. During your use of our Service we may collect Non-Personal Information about your use of the Services. Non-Personal Information we invite you to share about yourself may, without limitation, include:

your age or date of birth; your gender; as well as any other relevant, non-personal information that is included in communication with us, our Service, social networks, or other online profiles.

We may also receive your non-personal and/or public information from third-parties in connection with market and demographic studies, as well as via your direct input of such data into our Services.

Non-Personal Information that is collected by S1M is exclusively owned by S1M and may be used as it sees fit in accordance with applicable law. If Non-Personal Information is collected for an activity that also requires Personal Information, we may combine your Non-Personal Information with your Personal Information in an attempt to provide you with a better user experience, to improve the value and quality of the Services, and to analyze how the Services are used.

In addition to the collection of your Personal Information and Non-Personal Information, some additional device information may be shared automatically, not limited to, but including your:

computer or Service-accessing device information; software; platform; incident data; IP addresses; network Media Access Control (MAC) address and connection; browser type and language; referring pages, exit pages, and URLs associated with such; number of clicks; domain names; landing pages; pages viewed and the order of those pages; the amount of time spent on particular pages; and the date and time of Service use/activity

This information helps Sponsors and us to better understand customer behavior and improve upon products, services, and advertising.

Use of Data Collected

S1M uses information about you for various purposes, not exhaustive of, but including to:

enable users to access and use our Services; personalize our Service; optimize the type of content presented to users when they use our Service; operate, protect, improve, and optimize our Service, our business, and our users’ experience; manage user accounts; create and maintain a trusted environment where we can detect and prevent service interruption; carry out customer support, such as to investigate and appropriately respond to any Service errors; send users service, support, and administrative messages, reminders, technical notices, updates, security alerts, and information requested by users; perform analytics, conduct research, and monitor and analyze trends, usage, and activities in connection with our Services; communicate with users about products, services, offers, promotions, sweepstakes, donations, rewards, and events offered by S1M and others, as well as to provide advertisements that match user profiles or interests, news, and information that we think will be of interest to users; comply with our legal obligations or requests from law enforcement agencies, resolve any disputes that we may have with any of our users, and to enforce agreements with third-parties; link or combine information we get from others in order to help understand your needs and provide you with better service; and to carry out any other purpose for which the information was collected.

If we advertise, we (or a third-party) may use certain data collected on our Service to show you S1M advertisements on other sites or applications (for more information about interest-based ads, or to opt out of having your web browsing information used for behavioral advertising purposes, where applicable, please visit http://www.networkadvertising.org/choices/ and/or http://www.aboutads.info/choices/).

We will retain and use your information for as long as we deem relevant. How your Data is Shared

Not exhaustive of the descriptions that follow, or as otherwise informed of in this Privacy Policy, we may share information about you:

to enforce or apply this Privacy Policy and its included terms, as well as any other appropriate policies or agreements; in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company; between and among S1M, as well as any of its current or future parents, affiliates, subsidiaries, and/or other companies under common control or ownership; with Sponsors, consultants, and other service providers who need access to such information to carry out work on our behalf (including, without limitation, third-party service providers that may help us to detect inaccurate or fraudulent personal identification and related information); in response to a request for information if we believe disclosure is in accordance with any applicable law, regulation, or legal process, or as otherwise required by any applicable law, rule, or regulation; and/or with your consent or at your direction, including if we notify you through our Service that the information you provide will be shared in a particular manner and you subsequently provide such information.

Our Services may offer social sharing features and other integrated tools (such as a Facebook “Like” button), which let you share your actions on our Service with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. Additionally, without restriction and without consent from you, we may share aggregated or de-identified information that cannot reasonably be used to identify you.

We do not rent, sell, share, or trade your Personal Information with third-parties other than as disclosed within this Privacy Policy and our Terms and Conditions.

Third-Party Interactions with Your Data

S1M may obtain information from other sources and combine that with information we collect through the Service in order to enhance our ability to serve you, to tailor our content to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you. For example, if you create or log into your account through a social media site, we will have access to certain information from that site, including, but not limited to, your name, account information and friends lists—this information being provided in accordance with the authorization procedures determined by the social media site providing it.

There are a number of places on our Service where you may click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on an advertisement on our Service, you may be taken to a website that we do not control. These third-party websites may independently solicit and collect information, including personal information from you, and in some instances, provide us with information about your activities on those websites. We recommend that you consult the privacy statements of all third-party websites you visit by clicking on any “privacy” or “terms and conditions” links they might provide—these are typically located at the bottom of a webpage. You understand that when you use the Service, information you provide via the Service, information you grant access to by using the Service, as well as any information you share with individuals through the Service, may be available to other users and in some cases made publicly available.

Our Services include social media features, such as connecting to our Service via your Facebook account. Such features may allow the third-party social networking entity you connect to our Service with, to collect information about your IP address and the pages you visit within our Services. The third-party social networking entity may also use cookies to make sure features function properly in combination with our Service. Within our Services, social media features and widgets are either hosted by a third-party or hosted directly on our site. We maintain presences on social media platforms as well, including, but not limited to, Facebook, Twitter, LinkedIn, and Instagram. Any information, communications, or materials you submit to us via a social media platform is done so at your own risk, without any expectation of privacy. We cannot control the actions of other users of any platforms, nor can we control the actions of any platform not ours. Your interactions with the aforementioned features and social media platforms are governed by the privacy policies and terms and conditions of the companies that provide them. We are not responsible for any user or third-party circumvention of any privacy settings or security measures contained on the services.

Where companies provide services to help us with our business activities, we may provide information to companies that can identify you personally. These third-parties are authorized to use your information only as necessary, in the scope of providing services to us. We may also disclose information that is able to personally identify you as it is required by law in compliance with a subpoena, or similar legal process. To the extent we are legally permitted to do so, we will take commercially reasonable steps to notify you if we are required to provide your Personal Information to third-parties as part of legal process. Your Personal Information will only be shared with third-parties by us as it is provided for in this Privacy Policy and our Terms and Conditions.

Your correspondence or business dealings with, or participation in purchase of goods, use of coupons, promotions of, advertisers found on or through the Services, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such third-party.

User Age

S1M does not knowingly collect or solicit any information from anyone under the age of 13, nor do we knowingly allow such persons to register for our Services. The Service and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at any of the addresses listed in our contact section below.

S1M reserves the right to verify, by means it deems most appropriate, the actual age of any user that has provided their data through this form, and may refuse access to services offered to users not of an “appropriate age.” Further, in such an instance and if we deem necessary, we will proceed to cancel and eliminate an account connected to such an individual.

Privacy Rights and Contact Information

By Opting In, you acknowledge receipt and review of this Privacy Policy. Going forward, it is then your obligation to check that you have reviewed the most up to date Privacy Policy in regards to using our Service. We will retain and use your information for as long as we deem relevant. If you want us to no longer use your information in the manner as set forth herein, you may notify us of such request at any time by sending an email to the following email address Unsubscribe@Sports1Marketing.com ("Opt Out"). At any time, you may opt out of any future data collection that would occur beyond the date S1M receives and processes your Opt Out request. Please be aware, your Opt Out may limit or cancel your account completely. Also note that, even if you so Opt-Out, your Personal Information may still be disclosed to third-parties to the extent that you affirmatively provide it to third-parties through our Service (for example, by posting it using functionality in our Service).

S1M may choose to unilaterally process your record deletion if S1M does not receive any confirmations deemed necessary by us, or for any other reason. If this happens, your data will be cancelled in accordance with the regulations of data protection.

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that a company the resident has an established business relationship with has shared with third-parties for direct marketing purposes during the proceeding calendar year. In particular, the law provides that companies must inform consumers about the categories of Personal Information that have been shared with third-parties, the names and addresses of those third-parties, and examples of the types of services or products marketed by those third-parties. To request a copy of the information disclosure provided by S1M pursuant to Section 1798.83 of the California Civil Code, please contact us via the email or address stated above. Where we are obligated, please allow 30 days for a response.

If you reside outside of the country, you may have the right to be provided with notification of the Personal Information that we have collected about you and written information about our policies and practices with respect to the transfer of your Personal Information to Sponsors. Australian domiciled users who access, sign into, and/or register to use our Service in Australia, and do so while providing their own Personal Information, shall have confirmed consent to the collection, use, storage, and disclosure of their Personal Information by S1M. If you do not agree and consent in the manner set out in this clause, then you should not provide your Personal Information (in which case S1M may determine that you are not able to access the Services). All Personal Information collected or acquired by S1M as part of or in connection with our Service will be used and may be disclosed by S1M in accordance with S1M’s Privacy Policy and Terms and Condition. Without limiting the above, we will use your Personal Information in order to provide for our Service, as well as for related purposes and services, such as, but not limited to communicating with you (including through electronic messaging and for promotional and direct marketing purposes) about any events, programs, promotions, offers, products, and other activities of Sponsors or us. S1M may disclose your Personal Information and other data to certain third-parties who provide S1M with (or help S1M provide) products and services (including to its related entities, Sponsors, partners, and service providers—including those in the United States of America). S1M may also disclose your personal information to its partners, Sponsors, and other third-parties, where their purpose is to direct market to you. You agree and accept that the data and Personal Information you provide to S1M can be shared with all such third-parties referred to in this clause for these and related purposes. S1M will comply with all applicable Australian privacy legislation.
